1. Agreement to Terms

By accessing or using the website at fresh-cut-landscape.com or by requesting services from Fresh-Cut Landscaping LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

2. Services Provided

Fresh-Cut Landscaping LLC provides residential and commercial outdoor property services in Virginia's 540 area code, including but not limited to:

• Lawn care and landscaping
• Mulching and bed maintenance
• Tree trimming and removal
• Gutter cleaning
• Leaf and junk removal
• Storm damage cleanup

All services are subject to availability, weather conditions, and service area confirmation by the owner, Alex M.

3. Free Estimates

All property estimate visits are provided at no cost and with no obligation to proceed. An estimate is not a binding contract. Final pricing is agreed upon in writing or verbally between the client and the owner before work begins.

4. Booking Requests

Submitting a booking request through our website does not guarantee a confirmed appointment. All requests are subject to review and confirmation by the owner. You will receive a call or text from Alex M. at (540) 455-7405 to confirm scheduling, typically within 2 hours during business hours.

5. Payment Terms

• Payment is due upon completion of the agreed service unless otherwise arranged in writing
• We accept cash, check, and common digital payment applications (Venmo, Zelle, CashApp)
• For larger projects, a deposit may be required before work begins — this will be communicated at the time of estimate
• Invoices not paid within 30 days of completion may accrue a late fee of 1.5% per month

6. Client Responsibilities

You agree to:

• Provide accurate property information (address, access details, hazards) when booking
• Ensure our crew has safe, lawful access to the property on the scheduled service date
• Notify us of any underground utilities, irrigation systems, septic tanks, or buried lines that could be affected by service
• Secure pets and inform us of any known hazards on the property

Fresh-Cut Landscaping LLC is not liable for damage resulting from inaccurate or incomplete property information provided by the client.

7. Cancellations & Rescheduling

Please see our Cancellation & Refund Policy for full details. In summary: we request at least 24 hours' notice for cancellations or rescheduling. Same-day cancellations may result in a service call fee.

8. Limitation of Liability

To the fullest extent permitted by Virginia law, Fresh-Cut Landscaping LLC's total liability for any claim arising from our services shall not exceed the amount paid by the client for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

We carry general liability insurance appropriate for our scope of work. Proof of insurance is available upon request.

9. Property Damage

In the unlikely event that our crew causes damage to your property during service, you must notify us within 48 hours of service completion. We will assess the damage in good faith and, if determined to be our responsibility, arrange repair or compensation. Claims made after 48 hours may not be honored.

10. Website Use

You agree to use this website only for lawful purposes. You may not use this site to submit false, misleading, or fraudulent booking requests. We reserve the right to refuse service to anyone for any lawful reason.

11. Intellectual Property

All content on this website — including text, images, graphics, logos, and design — is the property of Fresh-Cut Landscaping LLC or its content suppliers and is protected by applicable copyright law. You may not reproduce or redistribute content without prior written permission.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Virginia. Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Virginia, except that either party may seek injunctive relief in a court of competent jurisdiction.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Updated terms will be posted on this page with a revised date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
